1. DEFINITIONS
1.1 Company: Aulotech Gas & Heating.
1.2 Client: The individual or entity accepting the quotation.
1.3 Works: Boiler installation services, associated labour, and materials detailed in the accepted quotation.
1.4 Service Plan: Any promotional or paid service plan that may be included in a quotation by the Company.
2. AGREEMENT & ACCEPTANCE
2.1 Acceptance of a quotation by digital confirmation, signature, or payment of deposit constitutes full agreement to these Terms & Conditions.
2.2 Under the Consumer Contracts Regulations 2013, the Client has a 14-day cooling-off period from acceptance or deposit payment.
2.3 If installation is requested within the 14-day period, the Client waives the statutory right to cancel.
2.4 These Terms do not affect statutory rights under UK law.
3. PAYMENT TERMS
3.1 A 10% deposit is required to secure the booking.
3.2 The balance is payable immediately upon handover and prior to commissioning.
3.3 Late payment will incur a £100 + VAT fee plus interest at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts Act 1998.
3.4 Payment cannot be withheld for disputes; disputes shall follow the complaints procedure.
3.5 All quoted prices are subject to VAT at the prevailing rate unless otherwise stated.
4. COMMISSIONING
4.1 Boiler commissioning and handover will only occur after full payment has been received.
4.2 If payment is delayed, commissioning will be postponed.
4.3 If the Company must return at a later date to commission the boiler due to non-payment, a re-attendance charge of £100 + VAT will apply.
5. TITLE & OWNERSHIP
5.1 All goods remain the property of the Company until full payment is received.
5.2 Materials delivered to site become the Client’s responsibility for safekeeping; the Company accepts no liability for loss, theft, or damage once delivered.
5.3 In case of non-payment, the Company reserves the right to recover goods and charge associated costs.
6. GUARANTEES & WARRANTIES
6.1 The Company provides a 10-year workmanship guarantee on installation.
6.2 Manufacturer warranties apply under their own conditions.
6.3 The guarantee will be void if:
(a) Annual servicing is not performed by a Gas Safe engineer and proof is not retained;
(b) The system is altered, serviced, or repaired by any third party;
(c) Incorrect chemicals/components are used;
(d) Damage occurs due to misuse, neglect, or limescale.
6.4 The guarantee applies only to the original purchaser and installation property and is non-transferable.
6.5 The workmanship guarantee is conditional on the Client providing reasonable access and cooperation to allow remedial works to be carried out. If access is denied, appointments are missed, or the Client fails to engage with the Company’s attempts to arrange remedial works, the guarantee will be considered discharged with no further obligation on the Company.
7. SERVICE PLANS (Where Included in the Quotation)
7.1 If a service plan is included with your quotation, the following conditions apply:
(a) The Client is solely responsible for booking the service each year within the timeframe specified in the plan;
(b) No reminders will be sent by the Company;
(c) Failure to book within the timeframe will void the entire plan;
(d) Missed or late appointments and cancellations with less than 24 hours’ notice will result in forfeiture of that service and termination of the plan;
(e) Plans are non-transferable and cannot be extended, paused, or exchanged for cash value;
(f) If the boiler/system is altered by third parties or deemed unsafe, the plan terminates immediately;
(g) No refunds, credits, or compensation will be provided if the plan is voided or not used.
7.2 Any promotional offers, discounts, or service plans are at the sole discretion of the Company and may be withdrawn or amended without notice.
8. ADDITIONAL CHARGES
8.1 Additional charges apply for:
(a) Missed appointments or late cancellations;
(b) Unsafe site conditions;
(c) Parking or congestion fees;
(d) Delays caused by other trades.
9. CLIENT RESPONSIBILITIES
9.1 The Client shall:
(a) Ensure clear and safe access to the property;
(b) Provide electricity, gas, and water supply throughout the Works;
(c) Secure pets and valuables;
(d) Provide parking facilities or accept associated costs.
10. VARIATIONS & UNFORESEEN WORKS
10.1 Any works outside the quoted scope, including unforeseen system upgrades, require a separate quotation and written approval prior to commencement.
11. RIGHT TO SUSPEND WORK
11.1 The Company reserves the right to suspend work or withhold commissioning until outstanding payments or safe access is provided.
12. CANCELLATION POLICY
12.1 More than 7 days prior to start date: No charge.
12.2 Within 48 hours of start date: £100 + VAT call-out charge.
12.3 Same-day cancellation or refusal of access: 25% of the total quoted price.
13. COMPLAINTS & DISPUTE RESOLUTION
13.1 Complaints must be submitted in writing within 7 days of completion.
13.2 The Company will investigate and respond within 14 days.
13.3 All disputes will be referred to mediation before legal proceedings.
14. LIABILITY & FORCE MAJEURE
14.1 Company liability is limited to the contract value.
14.2 The Company accepts no responsibility for consequential losses (e.g., loss of earnings, damage unrelated to Works).
14.3 The Company shall not be liable for delays or non-performance due to events beyond its control, including but not limited to extreme weather, supplier delays, or government restrictions.
15. DATA PROTECTION
15.1 Customer data will be handled in accordance with UK GDPR and the Data Protection Act 2018.
15.2 Data will never be sold and will be used solely for fulfilling the contract or service plan.
16. TERMINATION FOR BREACH
16.1 The Company reserves the right to terminate the agreement or Service Plan immediately if the Client breaches any obligations under these Terms.
17. GOVERNING LAW
17.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
17.2 Any disputes shall be subject to the exclusive jurisdiction of the English courts.
